The German Legal System

The highest law in Germany is the Basic Law for the Federal Republic of Germany.  The basic principle of the German Judicial System is “Rechtsstaat.” In essence, all legal authority must be exercised in accordance with the rule of law. This means that any decision taken by a German authority can be challenged in court.

The German legal system differs fundamentally from the Anglo-Saxon common law system, in which courts rely mainly on precedents from prior cases called case law. The legal codes delineate abstract legal principles and the judges must decide the specific cases on the basis of these standards.

Germany has no entrenched preference for trial by jury. Furthermore, German trial judges are required to explain their decisions fully. In the United States, judges do justify their decisions in bench trials, but such trials are comparatively rare. Moreover, juries in the United States, and in England and Wales, do not have to justify their decisions at all.

The highest court in Germany, The Federal Constitutional Court, is very highly regarded worldwide. It is also known, amongst the international legal community, for being one of the most vocal national constitutional courts in the European Union. For instance, it was not until the case of Solange II that the Federal Court recognised the supremacy of EU law. However, the Federal Constitutional Court did add a caveat: EU law would be considered supreme so long as the ECJ maintained a level of protection of fundamental rights substantially in concurrence with the protections afforded by the German constitution.
