Disputes requiring out-of-court solutions occur regularly and the use of ‘arbitrators’ is common to resolve civil and commercial disputes in both domestic and international settings. Arbitral awards act in the same way as final judgements and parties who enter into binding arbitration must comply with the arbitration award which is a legally enforceable document. The very enforcement of these awards is bound up in international treaties and clauses, again, requiring interpreters where there is no common language.
Norway does not possess a formalised jury system; unlike most of the common law world. Rather, Norway has a judge led justice system. This is mitigated by the presence of lay judge(s) who are ordinary members of the public and possess no formal legal qualifications. The lay system, which began over 100 years ago, is said to provide a corrective counterbalance against official power and the establishment.
This system also ensures that citizens play a key role in the development of Norwegian jurisprudence.
